Terms of Use
This is a translation provided for convenience. The authoritative version is the German one at Nutzungsbedingungen.
1. Scope
These terms apply to the use of the application provided at meldungen.app. The provider is the person named in the legal notice.
2. What is offered
The application shows, on a screen, who has raised their hand in a Zoom meeting. To do so it joins a meeting as an ordinary participant, using credentials you enter yourself, and displays who has raised a hand. It transmits neither audio nor video and records nothing.
If you grant the application host or co-host rights in the meeting, it can also act on two things: tapping a raised hand unmutes that person, and a button lowers all raised hands at once. Both happen only when someone operates them. Without those rights the application is display only.
3. No charge, no guaranteed availability
Use is free of charge. There is no entitlement to availability. The service is run privately and without any intention to make a profit; it may be changed, limited or discontinued at any time. Where interruptions can be planned, I will announce them beforehand if possible.
Do not rely on this tool alone for important events. Keep a simple fallback ready.
4. Requirements for use
You need your own Zoom account and permission to join the meeting in question. The one-off authorization must be granted with the account that owns the meeting, and only by a person entitled to do so. How that works is described in the guide.
Use of Zoom is governed by the terms of Zoom Communications, Inc. Those remain unaffected by these terms.
5. Your obligations
You ensure that the participants of the meeting know that their names may become visible on a screen. You do not use the application to monitor participants, and you do not use it for unlawful purposes. You do nothing that disrupts operation or places a disproportionate load on it.
6. Liability
I am liable without limitation for damage arising from injury to life, body or health, and for damage based on intent or gross negligence.
In the case of slight negligence in breaching an obligation whose fulfilment is what makes proper performance possible in the first place and on whose observance you may regularly rely (a cardinal obligation), liability is limited to the foreseeable damage typical for this kind of contract at the time it was concluded. Otherwise liability for slight negligence is excluded.
Liability under the German Product Liability Act remains unaffected.
7. Termination
You can stop using the service at any time by removing the authorization in your Zoom account. Everything stored for your account is then deleted without delay. The steps are described in the guide.
8. Changes to these terms
I may change these terms where this becomes necessary for legal or technical reasons. Changes will be announced here. Continued use after publication counts as acceptance of the changed terms.
9. Applicable law
The law of the Federal Republic of Germany applies. Mandatory consumer protection provisions of the state in which you have your habitual residence remain unaffected.
